In my last video earlier today, I explained that a government legal paper sent to the Edinburgh Court of Sessions said that Boris Johnson would send the Benn Surrender Act letter to request an Article 50 extension, if no deal were in place by the 19th of October.

This would appear to be in direct contravention to his Brexit do or die by the 31st of October and dead in a ditch comments.

This news will of course lead to both parliament and the EU turning down all deals in the comfortable knowledge that the UK will then be forced to remain in the EU until the 31st of January 2020.

However, Boris Tweeted the following out this afternoon:

"New deal or no deal - but no delay. #GetBrexitDone #LeaveOct31"

Now, this will have the effect of rallying the Brexiteer troops and well as putting real doubt into the minds of the Remainers. Actually, more than doubt, this will send them up the wall!

Also, there was a recent interview with Tory Brexiteer MP Steve Baker, who told BBC Newsnight host Emma Barnett that Boris Johnson does have a plan to deal with the legalities of leaving the EU without a deal on the 31st of October.

When asked if he knew what the plan was, he said:

"I've had a number of conversations with a number of ministers, I'm very clear that they believe they have a way through."

And he went on to say that he didn't wish to know what that plan was, because as soon as it was discussed publicly it would just cause the Remainers to react with great furious anger to try and stop it.

He also said:

"I’m afraid when you look at their willingness to overturn every constitutional convention to break their promises and manifestoes, to try and overturn a referendum result.

“I mean they have breached the rules of the House of Commons. He said, and went on,

“Our opponents are willing to stop at nothing to stop Brexit.

“And in such circumstances, I am quite happy that the Government should enjoy secrecy on this point.”

So, given that a legal memo to a court says that the government position is to send that letter, if required. But the PM is openly Tweeting out within the last hour or so that the UK will be leaving the EU on the 31st of October, deal or no deal, with the Remainers having no idea how that could work, it would have to be a humdinger of a plan.

Let's hope it works!
